Amicus Brief - City of Milwaukee v. Washington
This Amicus Brief was drafted by Manitowoc County Corporation Counsel for the Wisconsin Association of County Corporation Counsels and filed with the Wisconsin Supreme Court in City of Milwaukee v. Washington, 2005-AP-3141. The court will decide whether Wisconsin law permits a noncompliant tuberculosis patient to be confined in jail to assure that a medically prescribed treatment regimen is completed in order to keep the disease from spreading.

Decision - FFRF v. Manitowoc County
A federal judge issued this decision dismissing a lawsuit brought by the Freedom from Religion Foundation, Inc. against Manitowoc County. FFRF had alleged that Manitowoc County violated the Establishment Clause of the First Amendment to the United States Constitution by allowing a nativity scene to be displayed on the courthouse lawn during the Christmas season.

This form is used to bid on property that Manitowoc County owns as the result of an "in rem" tax foreclosure action.

Opinions
Emergency Medical Dispatch Protocols
The Joint Dispatch Center provides emergency medical dispatch (EMD) using protocols licensed from Priority Dispatch Corporation. Deviations from these protocols reduce the effectiveness of the EMD process and jeopardize the safety of the public and emergency service providers. They compromise the integrity of the protocols, void legal defenses based on governmental immunity, substantially increase the county’s liability exposure, and violate the terms of the county’s contract with Priority Dispatch. Consequently, unauthorized deviations from these protocols must be avoided.
Full-time or Part-time Status of Elective Office (Coroner)
The elective office of coroner is full-time. The county board has substantial discretion in setting the salary and benefits for the office so long as the salary is not unreasonable. But the coroner is solely responsible for determining the number of hours that he or she works. Thus, the underlying issue is not whether the office is full-time or part-time, but whether the compensation is reasonable in light of the importance and responsibility of the office.
Open Meetings, Public Records, and the Economic Development Corporation
Under the standards articulated by the Wisconsin Supreme Court in State v. Beaver Dam Area Development Corporation, 2008 WI 90, the Economic Development Corporation of Manitowoc County is a quasi-governmental corporation and is subject to Wisconsin's open meetings and public records laws.
Opening Outgoing County Mail
The county clerk's action in opening a letter that was placed in the county's internal mail system without proper postage or a return address is consistent with sound business and governmental practice and does not violate federal law.
Rebuttal Testimony before the Board of Adjustment
The decision about whether to permit rebuttal testimony or evidence is within the Board’s discretion. In exercising that discretion, the Board should allow rebuttal evidence to address new facts or issues that have been brought out by one party if the other party has not had an opportunity to address the new fact or issue. But the Board is not required to permit additional evidence to be presented merely because a party has responded to evidence presented by the other side.
Resolution Amending Travel Policy (Motorcycle Use)
Manitowoc County's travel policy, which is incuded in the Employee Policy Manual, applies to a county board supervisor who is in the course of performing official duties. However, it is within the county board's power to exempt itself from the policy.
SAIL Program
County participation as an Executive Sponsor of the SAIL program, which is intended to provide a social network for young professionals, probably does not satisfy the public purpose doctrine. While the SAIL program serves both public and private purposes, it appears that the principal benefits of the program are private and accrue to the individuals who participate in it. The public benefits appear to be incidental to the private benefits and are somewhat remote and uncertain. Additionally, there doesn’t appear to be any kind of control or limitation to assure that public monies will be used to achieve a public purpose. Nor is there any assurance that the achievement of the public purpose is a reasonable probability. Finally, it does not appear that public funding is necessary to the success of the SAIL program.
